Wedding Photography Terms and Conditions
Captured by Chris
These Terms and Conditions apply to all wedding photography bookings made with Captured by Chris. By accepting a quote and paying the booking fee, you confirm that you have read, understood and agreed to these Terms and Conditions.
Your accepted quote will set out the key details of your booking, including your wedding date, venue, package, coverage time, price and payment schedule. These Terms and Conditions should be read alongside that quote.
1. About Us
Captured by Chris provides wedding photography services in the UK.
For the purpose of these Terms and Conditions, “Photographer”, “I”, “me” and “my” refer to Captured by Chris. “Client”, “you” and “your” refer to the couple or person making the booking.
2. Your Booking
A booking is confirmed once:
your quote has been accepted, and
the booking fee has been paid.
Until both of these steps have been completed, your date is not secured.
The accepted quote forms part of the agreement and confirms the booking specific details, including:
the wedding date
the venue or venues
the agreed coverage
the agreed price
any agreed extras or add ons
the payment schedule
If there is any conflict between these Terms and your accepted quote, the accepted quote will take priority for the booking specific details.
3. Services
I agree to provide wedding photography services as described in your accepted quote.
This may include:
photography coverage on the wedding day
professional editing of the final selected images
delivery of the final images via an online gallery
any additional products or services included within your chosen package or agreed separately in writing
All photographs are created in my usual documentary style and edited in line with my portfolio and brand.
4. Exclusive Photographer
By booking me, you agree that I will be the main professional photographer covering your wedding unless otherwise agreed in writing.
Guests are welcome to take their own casual photographs. However, I cannot be held responsible for missed moments, blocked shots or compromised images where guests, other suppliers or venue restrictions interfere with my ability to work.
5. Booking Fee and Payments
A booking fee is required to secure your date. The amount will be shown on your quote.
The booking fee is deducted from the total cost of your package.
The remaining balance must be paid in line with the payment schedule shown on your quote.
If payment is not received by the agreed due date, I reserve the right to pause work, withhold delivery, or cancel the booking. If a booking is cancelled due to non payment, this will be treated as a cancellation by the Client.
6. Booking Fee and Refunds
The booking fee is charged because I reserve your date and may turn away other work once your booking is confirmed.
If you cancel your booking, the booking fee will usually not be refunded.
However, nothing in these Terms affects your legal rights, and any refund due will be handled in line with applicable UK consumer law. UK guidance makes clear that businesses dealing with consumers must use fair terms, and blanket no refund clauses may be unfair. (GOV.UK)
7. Client Responsibilities
You agree to provide accurate information about your wedding plans and to keep me informed of any important changes.
You are responsible for:
ensuring I have the correct timings, addresses and contact details
obtaining any necessary permission for photography at the venue
making me aware of any venue restrictions in advance
arranging enough time in the schedule for any requested group photographs
ensuring key people are available when needed for formal photographs
providing a safe working environment
If I am booked for more than 5 hours of continuous coverage, you agree to provide a meal or cover a reasonable meal cost.
8. Coverage, Timings and Group Photos
I will make every reasonable effort to capture the wedding day fully and professionally. However, wedding photography depends on timings, weather, venue conditions, available light, access, cooperation from guests and the natural flow of the day.
You understand and accept that:
no specific image can be guaranteed
some moments may be missed if the schedule runs late or changes without notice
group photos can only be completed if enough time is allowed
the quality and quantity of images may be affected by factors outside my control
9. Artistic Style and Editing
By booking Captured by Chris, you confirm that you are familiar with my work and are happy with my style, approach and editing.
You acknowledge that:
my work is documentary led and naturally observed where possible
I use professional judgement to decide how best to photograph and edit the day
final image selection and editing decisions remain at my discretion
unedited RAW files are not supplied
A dislike of individual poses, expressions, compositions or editing decisions is not a valid reason for cancellation, refusal to pay, or request for refund.
10. Delivery of Images
Your final gallery will be delivered within the timeframe stated in your quote, booking confirmation, or other written communication.
Images will usually be delivered by online gallery.
I am not required to deliver every image taken and I reserve the right to remove duplicate frames, test shots, closed eyes, unflattering expressions and any images that do not meet my quality standards.
Where delivery is delayed due to illness, emergency, technical issues or circumstances outside my reasonable control, I will keep you informed and complete delivery as soon as reasonably possible.
11. Copyright and Personal Use
Copyright in all photographs remains with Captured by Chris at all times.
Once your final gallery has been delivered and paid for in full, you are granted a personal use licence. This means you may:
download, print and share the images for personal use
post them on personal social media
share them with friends and family
You may not:
sell the images
edit them heavily or apply filters
submit them for commercial use
give them to suppliers, venues, magazines or businesses for marketing or publication without my permission
12. Use of Images by Captured by Chris
Unless otherwise agreed in writing before the wedding, I may use images from your wedding for my portfolio, website, blog, social media, promotional material and other marketing purposes.
If you have privacy concerns, please raise these before booking so we can discuss them properly.
13. Cancellation by You
If you cancel your booking, you must notify me in writing.
The booking fee will usually be retained.
Depending on when you cancel and what work has already been carried out, additional payments made may also be retained where this is reasonable and reflects losses or costs already incurred. Under UK consumer law, cancellation terms and charges must be fair and proportionate. (GOV.UK)
14. Rescheduling
If you need to move your wedding date, I will make reasonable efforts to transfer your booking to the new date.
If I am available for the new date, payments already made may be transferred.
If I am not available, the change will be treated as a cancellation by you and clause 13 will apply.
15. Cancellation or Inability to Perform by Me
If I am unable to attend your wedding due to serious illness, injury, family emergency, death, accident or another circumstance beyond my reasonable control, I will make reasonable efforts to find a suitable replacement photographer.
If a suitable replacement cannot be found, or is not accepted by you, I will refund any sums paid for services I am unable to provide. This approach is more consistent with UK guidance that consumers should not be deprived of refunds where the trader does not provide the service. (GOV.UK Assets)
16. Force Majeure
Neither party will be liable for delay or failure to perform their obligations where that delay or failure is caused by events beyond their reasonable control. This may include serious illness, accident, severe weather, fire, flood, transport disruption, venue closure, government restrictions or other emergencies.
Where possible, both parties will work together in good faith to find a fair solution, including rearrangement where practical.
17. Limitation of Liability
I will provide my services with reasonable care and skill. UK consumer contracts for services are subject to statutory protections, including the requirement that services be performed with reasonable care and skill. (Legislation.gov.uk)
If something goes wrong due to my breach of contract or negligence, my liability will be limited to the total amount paid under the booking, except where the law does not allow liability to be limited.
Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded or limited under UK law.
I am not liable for:
missed images caused by guests, venue staff or other suppliers
restrictions imposed by registrars, celebrants, venues or places of worship
poor weather or poor light where these affect results
interruptions, delays or failures caused by events outside my reasonable control
loss or damage arising from your misuse of digital files after delivery
18. Communication
You agree that I may contact you using the email address, phone number or other contact details you provide when enquiring or booking.
It is your responsibility to check your inbox, junk or spam folders and to ensure your contact information remains accurate.
19. Governing Law
These Terms and Conditions are governed by the laws of England and Wales.
Any dispute arising in connection with these Terms and Conditions or your booking will be subject to the jurisdiction of the courts of England and Wales.
20. Entire Agreement
These Terms and Conditions, together with your accepted quote and any written amendments agreed by both parties, form the entire agreement between us.
21. Acceptance
By accepting your quote and paying the booking fee, you confirm that you have read, understood and agreed to these Terms and Conditions.
